1. INTRODUCTION AND ACCEPTANCE OF TERMS

1.1 About Deal Chahta Hai

Deal Chahta Hai (hereinafter referred to as "Company," "we," "us," or "our") is a licensed Real Estate Channel Partner registered with Haryana RERA (Registration Number: RC/HARERA/GGM/3989/3584/2026/24), headquartered in Gurugram, Haryana, India. The Company operates a digital platform, including its website, mobile application(s), and any affiliated digital or offline channels (collectively, the "Platform"), for the purposes of marketing real estate properties, generating and qualifying leads, and facilitating connections between multiple stakeholders in the real estate ecosystem.

1.2 Nature of Our Business

Deal Chahta Hai functions primarily as:

  1. A lead generation and intermediary platform connecting prospective buyers, sellers, tenants, landlords, investors, developers, and other real estate stakeholders.

  2. A property information and marketing service provider that aggregates and presents real estate project information, property listings, and developer communications.

  3. A real estate advisory and coordination service that may facilitate introductions, site visits, document submissions, and preliminary discussions between users and developers or sellers.

Importantly: Deal Chahta Hai is NOT:

  • A property developer, builder, or owner (unless explicitly stated for a specific project).

  • A sales agent or direct representative of any developer (unless specifically authorized in writing for particular projects).

  • A legal, tax, financial, or investment advisor.

  • A party to any property purchase, rental, lease, or investment agreement.

  • A regulated lending institution or financial service provider (though we may coordinate with loan partners).

1.3 Acceptance of Terms

By accessing, browsing, or using the Platform in any manner—including but not limited to viewing property listings, submitting enquiry forms, providing contact information, clicking on links, or engaging with our content—you ("User" or "you") acknowledge and agree that you have:

  1. Read, understood, and accepted all terms, conditions, disclaimers, and policies contained herein.

  2. Understood the intermediary nature of Deal Chahta Hai's services and the limitations of the information we provide.

  3. Agreed to be bound by these Terms of Use ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must immediately cease access to and use of the Platform.

Continued use of the Platform after any modifications to these Terms constitutes acceptance of the updated Terms. We recommend that you periodically review these Terms for any changes.

1.4 Age and Eligibility

By using the Platform, you represent and warrant that:

  1. You are at least 18 years of age and possess the legal capacity to enter into binding agreements under applicable laws.

  2. If you are acting on behalf of a legal entity (company, trust, partnership, etc.), you are authorized to bind that entity to these Terms.

  3. You are not legally prohibited from engaging in real estate transactions or using financial services under applicable laws (e.g., no sanctions, no restrictions, legally competent).

  4. You are not using the Platform for any unlawful purposes or in violation of any applicable laws or regulations.

2. INTERMEDIARY STATUS AND LIMITED ROLE

2.1 Intermediary, Not a Developer or Owner

Deal Chahta Hai operates as an intermediary facilitator. We do not:

  • Develop, construct, or own the properties or projects listed on the Platform (except where explicitly and separately disclosed).

  • Guarantee the completion, quality, legal compliance, or performance of any project or property.

  • Enter into any contract with you on behalf of developers or sellers (except where we have explicit written authority, which would be clearly communicated).

  • Hold or control any funds, deposits, or payments related to property transactions.

All transactions, agreements, and legal relationships are solely between you and the respective developer, seller, landlord, or other counterparty, not between you and Deal Chahta Hai.

2.2 Role in Lead Generation and Facilitation

Our services primarily include:

  1. Information aggregation: Collecting and presenting property details, project information, and marketing collaterals from publicly available sources and developer communications.

  2. Lead capture and qualification: Accepting your contact information and property preferences through forms, calls, or other channels; qualifying you as a potential buyer, tenant, investor, or seller.

  3. Lead routing: Sharing your information and enquiry with relevant developers, sellers, landlords, channel partners, or their authorized representatives so they can contact and serve you directly.

  4. Facilitation of communication: Helping arrange calls, messages, site visits, or meetings between you and relevant stakeholders.

  5. Content provision: Offering project information, market insights, locality details, and general real estate guidance for informational purposes only.

2.3 No Authority to Bind or Represent

Unless explicitly stated in writing and authorized under a separate agreement:

  • Deal Chahta Hai does not represent, act for, or speak on behalf of any developer, seller, landlord, or financial institution.

  • We have no authority to negotiate, finalize, bind, or commit any party to any transaction, payment, timeline, specification, or other material term.

  • Any representations made by Deal Chahta Hai staff about project features, pricing, or approval status are informational and subject to verification with the official developer or regulatory authorities.

  • We are not liable if any developer, seller, landlord, buyer, tenant or partner fails to fulfill commitments, changes terms, refuses to deal, or acts contrary to information shared by us.

2.4 Independent Verification Responsibility

All decisions regarding property purchases, investments, rentals, or other transactions are YOUR responsibility.

You acknowledge and agree that:

  1. You have the sole responsibility to independently verify all project information, legal status, regulatory approvals, financial viability, and any other material facts before committing to any transaction.

  2. You will consult with qualified professionals (lawyers, financial advisors, engineers, tax consultants, etc.) before making any decision.

  3. You will verify RERA registrations, project approvals, and regulatory status directly through official portals (e.g., https://haryanarera.gov.in/) and not rely solely on information presented by Deal Chahta Hai.

  4. You understand that the Platform provides indicative information for marketing and informational purposes only, and is not an official prospectus, offer document, or legal instrument.

3. INFORMATION, ACCURACY, AND DISCLAIMERS

3.1 Source and Nature of Information

All project details, property listings, images, specifications, amenities, configurations, floor plans, and descriptions displayed on the Platform are sourced from:

  • Publicly available materials (government records, municipal data).

  • Developer brochures, marketing communications, and promotional materials.

  • Real estate aggregators, portals, and public databases.

  • Third-party sources and user-submitted information.

We do not independently verify the accuracy or completeness of this information.

3.2 Information Subject to Change

All information presented on the Platform, including but not limited to:

  • Project specifications, layouts, amenities, and features.

  • Possession timelines, completion schedules, and milestones.

  • Pricing, payment plans, offers, and promotional terms.

  • RERA registration numbers, approval status, and regulatory compliance details.

  • Bank tie-ups, loan eligibility, and financing options.

  • Ownership structure, promoter details, and developer credentials.

is subject to change without notice by the developer, regulatory authority, financial institution, or other responsible stakeholder. We are not responsible for updating the Platform to reflect such changes in real-time. Also, while we try to verify facts, the possibility of a human or machine error can’t be ruled out entirely and therefore can’t be reason for holding us responsible for such unintended errors or omissions.

3.3 No Warranties or Representations

Deal Chahta Hai makes no representations or warranties—express, implied, statutory, or otherwise—regarding:

  1. Accuracy: The completeness, accuracy, timeliness, or reliability of any information on the Platform.

  2. Legality: The legal compliance, approval status, or regulatory clearance of any project or property.

  3. Quality or Performance: The quality of construction, durability, structural integrity, architectural design, or performance of any property or amenity.

  4. Title and Ownership: The legal title, ownership rights, encumbrances, liens, mortgages, or any other interest affecting any property.

  5. Returns and Appreciation: Any promise, guarantee, or expectation of financial returns, property appreciation, rental income, capital protection, or investment performance.

  6. Loan Approval: Loan sanctioning, eligibility, interest rates, or approval by any bank or financial institution (even if we facilitate connections).

  7. RERA Compliance: That any project or developer meets RERA requirements, or that information is compliant with RERA guidelines (users must verify directly with RERA).

  8. Non-Infringement: That the use, display, or reproduction of any content or images does not infringe upon third-party intellectual property rights.

  9. Fitness for Purpose: That the Platform or any information is fit for any particular purpose or meets your specific requirements.

3.4 "As-Is" and "As-Available" Disclaimer

The Platform and all information, content, and materials are provided "AS-IS" and "AS-AVAILABLE" without any warranty of any kind. We expressly disclaim:

  • Warranties of merchantability, fitness for a particular purpose, non-infringement, and title.

  • Warranties that the Platform will be uninterrupted, error-free, secure, or virus-free.

  • Warranties regarding the quality, accuracy, completeness, or suitability of any third-party content or links.

3.5 User Diligence and Professional Advice

You acknowledge that:

  1. You are responsible for your own due diligence, research, and verification of all material facts.

  2. You should consult qualified professionals:

    • A registered lawyer for legal advice, title verification, and contractual matters.

    • A chartered accountant or tax consultant for tax implications and financial structuring.

    • A structural engineer or property inspector for technical verification and condition assessment.

    • A financial advisor for investment suitability and loan-related decisions.

  3. Deal Chahta Hai does not provide legal, tax, financial, investment, or professional advice. Any general information we provide is for educational purposes only and does not substitute for professional consultation.

  4. You rely on such professionals at your own discretion. Any errors or omissions in professional advice are the responsibility of that professional, not Deal Chahta Hai.

4. USER ELIGIBILITY, CONDUCT, AND RESPONSIBILITIES

4.1 User Eligibility

You represent and warrant that:

  1. You are at least 18 years of age and a resident or citizen of India (or legally authorized to transact property in India).

  2. You are not a sanctioned individual, entity, or person prohibited from entering into contracts under anti-money laundering (AML), Know-Your-Customer (KYC), or other applicable regulations.

  3. You have the legal capacity and authority to enter into agreements regarding property transactions or investments.

  4. All information you provide is accurate, truthful, and not misleading.

4.2 Prohibited Conduct

You agree that you will NOT use the Platform to:

  1. Illegal activities: Engage in any unlawful, fraudulent, deceptive, or criminal activity.

  2. Misrepresentation: Provide false, incomplete, or misleading information about your identity, financial capability, intentions, or property requirements.

  3. Money laundering or sanctions violations: Engage in any activity that violates AML regulations, anti-terrorism financing rules, or sanctions regimes (including OFAC, if applicable).

  4. Impersonation: Pose as another individual, developer, real estate agent, or other person or entity.

  5. Unauthorized access: Attempt to gain unauthorized access to the Platform, hack, reverse-engineer, or attempt to break security measures.

  6. Data scraping: Automatically extract, scrape, or download data from the Platform without authorization.

  7. Content infringement: Upload, post, or share content that violates third-party intellectual property rights, including copyrights, trademarks, patents, or privacy rights.

  8. Defamation: Post or share content that is defamatory, libelous, slanderous, or infringes on the reputation of any individual or entity.

  9. Harassment or abuse: Engage in harassment, bullying, threats, abuse, or hostile behavior toward Deal Chahta Hai staff, other users, developers, or any third party.

  10. Unsolicited communications: Send unsolicited emails, spam, phishing attempts, or other bulk communications through the Platform or to users.

  11. Competing platform use: Use the Platform solely to gather information for use on competing platforms or to circumvent Deal Chahta Hai's services.

  12. Malware distribution: Introduce viruses, trojans, worms, malicious code, or any harmful software to the Platform.

  13. Unauthorized resale: Resell, redistribute, or commercially exploit the Platform or its content without authorization.

  14. Unauthorized linking: Create unauthorized links from external sites that frame or disguise the Platform or circumvent its functionality.

4.3 User Responsibility for Submitted Information

When you submit information through the Platform (contact details, enquiries, documents, messages, etc.), you:

  1. Warrant accuracy: Confirm that all information provided is accurate, current, and not misleading.

  2. Accept consequences: Understand and accept that inaccurate information may result in Deal Chahta Hai connecting you with irrelevant properties or developers being unable to serve you.

  3. Assume risks: Understand that sharing personal information carries inherent risks (identity theft, spam, unwanted contact) and you assume these risks.

  4. Consent to contact: Explicitly consent to being contacted by Deal Chahta Hai and authorized developers/sellers/partners via call, SMS, WhatsApp, email, or other channels.

4.4 Monitoring and Enforcement

Deal Chahta Hai reserves the right to (but is not obligated to):

  1. Monitor your use of the Platform for compliance with these Terms.

  2. Investigate violations or suspected violations.

  3. Remove, disable, or restrict access to any user-submitted content or accounts that violate these Terms.

  4. Report violations to law enforcement or regulatory authorities.

  5. Pursue legal remedies against users who breach these Terms or engage in unlawful conduct.

5. LIMITATION OF LIABILITY AND INDEMNIFICATION

5.1 Limitation of Liability – Core Principle

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, DEAL CHAHTA HAI SHALL NOT BE LIABLE FOR:

  1. Any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

    • Loss of profits, revenue, or income.

    • Loss of data, business opportunities, or anticipated savings.

    • Loss of reputation or goodwill.

    • Emotional distress or inconvenience.

    • Even if Deal Chahta Hai has been advised of the possibility of such damages.

  2. Any direct damages arising from:

    • Inaccuracies, errors, or omissions in Platform information.

    • Changes to project details, pricing, timelines, or specifications by developers.

    • Refusal by any developer, seller, landlord, or bank to deal with you.

    • Poor quality, defects, or non-performance of any property or project.

    • Any fraudulent, deceptive, or illegal conduct by developers, sellers, or other third parties.

    • Technical failures, interruptions, delays, or unavailability of the Platform.

    • Misuse of your personal information or unauthorized access to your data.

    • Viruses, malware, or security breaches affecting the Platform.

    • Any transaction, investment, or decision made based on Platform information.

  3. Loss or damage of any kind arising from third-party conduct, including but not limited to:

    • Actions or inactions of developers, sellers, landlords, banks, or other partners.

    • Breach of contract by third parties.

    • Regulatory changes or government policy shifts affecting real estate.

    • Force majeure events (natural disasters, pandemics, wars, civil unrest).

5.2 Cap on Liability

In no event shall Deal Chahta Hai's total cumulative liability to you—from all causes and claims combined—exceed the greater of:

  1. The fees or amounts actually paid by you to Deal Chahta Hai in relation to the specific service, transaction, or enquiry giving rise to the claim; or

  2. INR 2000 (Two thousand rupees), or the equivalent in your local currency.

5.3 Exceptions and Exclusions

The limitations in Sections 5.1 and 5.2 do NOT apply to:

  1. Gross negligence or willful misconduct

  2. Fraud by Deal Chahta Hai

  3. Death, personal injury, or product liability claims where exclusion is prohibited by law

5.4 Assumption of Risk

By using the Platform, you assume all risks associated with:

  1. Relying on any information, recommendation, or content provided by Deal Chahta Hai.

  2. Entering into any real estate transaction or investment based on Platform information.

  3. Sharing personal information or engaging with third parties facilitated through the Platform.

  4. Any loss, damage, or dispute arising from your decisions or actions related to property transactions.

5.5 Indemnification – User's Obligation to Protect Deal Chahta Hai

You agree to indemnify, defend, and hold harmless Deal Chahta Hai, its owners, officers, employees, agents, affiliates, and partners from and against:

  1. Any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from:

    • Your breach of these Terms or any applicable law.

    • Your misuse of the Platform or any content thereon.

    • Your inaccurate, misleading, or fraudulent provision of information.

    • Your violation of any third-party rights, including intellectual property rights, privacy rights, or contractual rights.

    • Your conduct, actions, or omissions in relation to any property transaction, investment, or engagement with third parties facilitated through the Platform.

    • Any claim by a third party (developer, seller, landlord, bank, regulator, etc.) arising from your use of the Platform or information obtained therefrom.

  2. Defense and settlement: Deal Chahta Hai shall have the right to defend any such claims at your expense and to settle any claim at your discretion. You shall cooperate fully in the defense of any such claims.

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Ownership of Platform Content

All original content, design, layout, graphics, logos, photographs, artwork, and compilations on the Platform (collectively, "Deal Chahta Hai Content") are the exclusive intellectual property of Deal Chahta Hai or its licensors, protected by copyright, trademark, and other intellectual property laws.

6.2 License to Use

Deal Chahta Hai grants you a limited, non-exclusive, non-transferable license to:

  1. View and access Deal Chahta Hai Content on the Platform for your personal, non-commercial use.

  2. Retain a single copy of any publicly available information for your personal records (not for commercial redistribution).

This license does NOT permit you to:

  1. Copy, reproduce, modify, or create derivative works from Deal Chahta Hai Content.

  2. Distribute, sell, rent, lease, or sublicense Deal Chahta Hai Content.

  3. Use Deal Chahta Hai Content for commercial purposes without written permission.

  4. Remove, obscure, or alter any copyright, trademark, or other intellectual property notice.

  5. Reverse-engineer, decompile, or attempt to discover the source code or methodology behind the Platform.

  6. Use automated tools (bots, scrapers, crawlers) to extract or systematically access Deal Chahta Hai Content.

6.3 Third-Party Content and Attribution

The Platform may include information, images, logos, and brochures from developers, real estate aggregators, government bodies, and other third parties ("Third-Party Content"). Such Third-Party Content remains the exclusive property of the respective owner and is used by Deal Chahta Hai:

  1. For identification and informational purposes with proper attribution (where feasible).

  2. Under licenses, permissions, or fair use provisions.

  3. In compliance with applicable intellectual property laws.

You acknowledge that:

  1. Third-Party Content is not owned by Deal Chahta Hai and remains subject to the intellectual property rights of the original owner.

  2. Your use of Third-Party Content is subject to the terms of the original owner (including the developer's or photographer's terms).

  3. Deal Chahta Hai is not responsible for any inaccuracies, infringements, or disputes arising from Third-Party Content.

6.4 User-Generated Content (If Applicable)

If the Platform permits users to submit content (reviews, messages, documents, images, etc.) ("User-Generated Content"):

  1. You retain ownership of the copyright in your User-Generated Content.

  2. You grant Deal Chahta Hai a royalty-free, perpetual, irrevocable, worldwide license to:

    • Use, reproduce, modify, and display your User-Generated Content on the Platform and in marketing materials.

    • Sublicense User-Generated Content to third parties for Platform-related purposes.

  3. You warrant that your User-Generated Content does not infringe on third-party rights and is not defamatory, obscene, or unlawful.

  4. Deal Chahta Hai may remove User-Generated Content that violates these Terms or is inappropriate.

7. COMMUNICATION, CONTACT, AND LEAD HANDLING

7.1 Communication Channels

By providing your contact information (phone number, email, WhatsApp, or other), you consent to Deal Chahta Hai and authorized partners contacting you via:

  1. Telephone calls (including pre-recorded or automated calls, subject to applicable telecom regulations).

  2. SMS (Short Message Service) and text messages.

  3. WhatsApp and other messaging applications.

  4. Email.

  5. Push notifications (if you use our mobile app).

  6. Mail and other postal means.

7.2 Frequency and Timing

You acknowledge that:

  1. You may receive multiple communications from Deal Chahta Hai and from developers/partners interested in your enquiry.

  2. Communications may occur multiple times per day until you explicitly opt-out or indicate disinterest.

  3. Deal Chahta Hai is not responsible for managing the frequency of communications from third-party developers or partners; each entity follows its own communication protocols.

7.3 Sharing Your Information

When you submit an enquiry or contact information through the Platform, Deal Chahta Hai will share your details with:

  1. Relevant developers or their sales teams associated with the project(s) you've enquired about.

  2. Channel partners and authorized brokers who may further market the project to you.

  3. Affiliated service providers (loan partners, legal consultants, event organizers) if relevant to your stated interests.

You explicitly consent to such sharing and understand that sharing occurs so that these entities can contact you directly to serve you better.

7.4 Opt-Out and Unsubscribe

You may opt-out of communications from Deal Chahta Hai by:

  1. Replying "STOP" to any SMS or WhatsApp message from us.

  2. Clicking "Unsubscribe" in any email communication.

  3. Emailing us at hello@dealchahtahai.com or the contact address provided in Section 12 (Grievance and Dispute Resolution).

  4. Calling us and requesting removal from our contact list.

Important note: Even if you opt-out, we may continue to send you:

  • Transactional communications related to a specific enquiry or transaction already in progress.

  • Communications required by law or regulation.

  • Responses to direct enquiries you've made.

7.5 Do-Not-Call and Telecom Regulations

Deal Chahta Hai shall comply with:

  1. National Customer Preference Register (NCPR) rules under Telecom Regulatory Authority of India (TRAI) guidelines.

  2. Do-Not-Call registries maintained by telecom operators.

  3. Telecom Commercial Communications Customer Preference Regulations (TCCCPR), 2018.

However, we note that real estate lead generation and pre-contractual communications may fall within exceptions under TRAI regulations. Nonetheless:

  • We will respect user preferences clearly communicated to us.

  • We will ensure that callers identify themselves as being from Deal Chahta Hai or authorized partners.

8. THIRD-PARTY LINKS, WEBSITES, AND SERVICES

8.1 External Links

The Platform may contain links to third-party websites, including:

  1. Developer websites and project pages.

  2. RERA portals and government regulatory databases (e.g., https://haryanarera.gov.in/).

  3. Bank and financial institution websites.

  4. Aggregator portals and property databases.

  5. Social media pages and other external platforms.

8.2 No Endorsement

Deal Chahta Hai:

  1. Does not endorse, recommend, or take responsibility for any third-party website, content, product, or service.

  2. Has no control over the content, accuracy, functionality, or policies of third-party websites.

  3. Is not responsible for any errors, omissions, unauthorized access, viruses, malware, or other issues affecting third-party sites.

8.3 Your Access to Third-Party Sites

When you access external links:

  1. You are leaving the Deal Chahta Hai Platform and entering a third party's domain.

  2. You are subject to the terms, privacy policies, and disclaimers of the third-party website, not Deal Chahta Hai's.

  3. You should review the third party's terms and policies before submitting any personal information or making any decisions.

  4. Deal Chahta Hai is not liable for any loss, damage, or dispute arising from your use of third-party sites.

8.4 RERA Verification

Particularly, for RERA-related information:

  1. Deal Chahta Hai does not certify or verify RERA registration numbers, project approval status, or compliance details.

  2. You are strongly advised to independently verify all RERA-related information directly through https://haryanarera.gov.in/ or by contacting Haryana RERA directly.

  3. Information about RERA status presented on the Deal Chahta Hai Platform is for reference only and may not be current or accurate.

9. REPRESENTATIONS AND WARRANTIES BY DEAL CHAHTA HAI

Deal Chahta Hai represents and warrants only the following:

  1. Authority: Deal Chahta Hai is duly authorized to operate the Platform and provide intermediary services in India, holding valid RERA registration (RC/HARERA/GGM/3989/3584/2026/24).

  2. No infringement of core licenses: Deal Chahta Hai owns or has valid licenses for all content and technology constituting the Platform, to the extent that such content does not infringe third-party rights (subject to the disclaimers in Section 3).

  3. Intermediary status: Deal Chahta Hai operates as an intermediary and does not represent itself as a developer, seller, or official agent of any third party, except where explicitly authorized and disclosed.

Except as expressly stated above, Deal Chahta Hai makes NO OTHER warranties of any kind.

10. NO FINANCIAL OR PROFESSIONAL ADVICE

10.1 Explicit Disclaimer of Advice

Deal Chahta Hai does not provide, and shall not be construed as providing:

  1. Financial advice: Recommendations regarding investments, returns, loan eligibility, interest rates, or financial structuring.

  2. Legal advice: Guidance on contracts, title verification, regulatory compliance, or legal obligations.

  3. Tax advice: Counsel on tax implications, deductions, or tax structuring related to property transactions.

  4. Real estate professional advice: Expert appraisal, valuation, inspection, or professional analysis of properties.

  5. Insurance advice: Recommendations regarding property insurance or coverage.

  6. Investment advice: Assessments of investment suitability, risk, or returns in real estate.

10.2 Educational Content Only

Any general information, market insights, locality details, or project overviews provided by Deal Chahta Hai are for educational and informational purposes only and should not be relied upon as professional advice.

10.3 Consultation with Professionals

You are strongly encouraged to:

  1. Consult a qualified lawyer for all legal matters, including reviewing agreements, verifying title, and understanding your rights and obligations.

  2. Consult a chartered accountant or tax consultant for tax implications and financial structuring.

11.2 Notice and Acceptance of Changes

  1. Material changes to these Terms will be communicated to you via email or a prominent notice on the Platform.

  2. Your continued use of the Platform after any modifications shall constitute your acceptance of the modified Terms.

12.3 Escalation and Mediation

If you are not satisfied with the resolution provided:

  1. You may escalate the grievance to the management by providing detailed written explanation.

  2. Deal Chahta Hai will engage in good-faith negotiation to resolve the dispute.

  3. If the parties agree, they may pursue mediation through a neutral third party before pursuing legal remedies.

12.4 Regulatory Complaints

In addition to Deal Chahta Hai's grievance mechanism, you may lodge complaints with:

  2. Consumer Protection Authority: If applicable under the Consumer Protection Act, 2019.

  3. National Consumer Redressal Commission (NCRP) or State Consumer Redressal Commission: For escalated consumer grievances.

12.5 Arbitration

  1. Disputes not resolved through grievance redressal or mediation may be subject to binding arbitration before a single arbitrator.

  2. Venue: Arbitration shall be conducted in Gurugram, Haryana, India, under the Arbitration and Conciliation Act, 1996.

  3. Costs: Each party shall bear its own costs; arbitrator fees shall be split equally unless the arbitrator determines otherwise.

  4. Scope: Arbitration shall cover all disputes except:

    • Intellectual property infringement claims.

12.6 Litigation and Jurisdiction

  1. Governing Law: These Terms and all disputes arising therefrom shall be governed by the laws of India, specifically the laws of the State of Haryana, excluding conflicts-of-law provisions.

  2. Exclusive Jurisdiction: All legal proceedings, suits, and claims arising from these Terms or your use of the Platform shall be brought exclusively in the courts of Gurugram, Haryana, or other courts having jurisdiction in Haryana.

  3. Waiver of Objections: By using the Platform, you irrevocably submit to the jurisdiction of the courts mentioned above and waive any objections to venue.

14. COMPLIANCE WITH LAWS AND REGULATIONS

14.1 Legal Compliance

  1. Real Estate (Regulation and Development) Act, 2016 and Haryana RERA Rules.

  2. Consumer Protection Act, 2019.

  3. Information Technology Act, 2000.

  4. Telecom Regulatory Authority of India (TRAI) regulations regarding communications.

  5. Prevention of Money Laundering Act (PMLA), 2002 and Know-Your-Customer (KYC) requirements.

  6. Anti-terrorism financing regulations under the Foreign Contribution Regulation Act (FCRA), if applicable.

  7. Applicable state and local laws regarding real estate intermediation, advertising, and consumer protection.

14.2 User Compliance

You agree to use the Platform in compliance with all applicable laws and regulations. Violations may result in:

  1. Termination of your access to the Platform.

  2. Legal action against you.

  3. Reporting to law enforcement or regulatory authorities.

14.3 Regulatory Changes

Deal Chahta Hai shall comply with any regulatory changes or directives issued by RERA, consumer authorities, or other government bodies. Such compliance may require modifications to the Platform or these Terms without advance notice.

15. SEVERABILITY, WAIVER, AND ENTIRE AGREEMENT

15.1 Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction:

  1. That provision shall be modified to the minimum extent necessary to make it enforceable.

  2. If such modification is not possible, that provision shall be severed or deleted.

  6. Power outages or utility failures.
